What every marketer must know

⏰ Statute of Limitations — 2 Years (Changed in 2023)

As of March 24, 2023, Florida reduced the statute of limitations for personal injury claims from 4 years to 2 years. This means clients have only 2 years from the date of their accident to file a lawsuit. This is why speed matters. The sooner they call, the better their case.

⚖️ Comparative Negligence — Modified System

Florida switched from "pure" to "modified" comparative negligence in 2023. If a client is found to be more than 50% at fault, they recover NOTHING. If they're 30% at fault, their award is reduced by 30%. Example: $100K case with 30% fault = $70K recovery. This is why telling them NOT to admit fault is critical.

🏥 PIP (Personal Injury Protection) — Florida's No-Fault System

Florida is a no-fault state. Every driver must carry PIP insurance, which covers up to $10,000 in medical bills and lost wages regardless of who caused the accident. BUT — clients must seek medical treatment within 14 days of the accident or they lose their PIP benefits entirely. This is why we push immediate medical attention.

Economic damages: Medical bills, future medical costs, lost wages, property damage, out-of-pocket expenses. Non-economic damages: Pain and suffering, emotional distress, loss of enjoyment of life, mental anguish. Punitive damages: Rare, but possible in cases of extreme recklessness (DUI accidents, etc.).

🚫 When to Step Over the Threshold (BI Claim)

To go beyond PIP and sue the at-fault driver for full damages, the injury must meet Florida's "serious injury" threshold: significant/permanent loss of a bodily function, permanent injury, significant scarring/disfigurement, or death. Most accidents with real injuries qualify — this is where the attorney earns their fee.

No-fault (PIP): Your own insurance pays your first $10K regardless of who's at fault. At-fault (BI claim): If injuries are serious, you can sue the person who caused the accident for the full amount of your damages. Consistent chiropractic treatment does two things: (1) It helps the client heal. (2) It documents ongoing injuries for the case. Insurance companies look at treatment gaps — if a client stops going to the chiropractor, the insurance says "they must not be hurt that bad." 3 visits per week is standard for the first 8-12 weeks. This is why we track chiro visits in the pipeline.

The Treatment Timeline

Week 1: ER or urgent care visit → get referred to chiropractor and orthopedic if needed. Weeks 1-12: Chiropractic care 2-3× per week, physical therapy if prescribed. Month 3-6: MRI if pain persists, specialist referrals, possible injections. Month 6+: Maximum Medical Improvement (MMI) determination, then the attorney negotiates the settlement.

What is Maximum Medical Improvement (MMI)?

MMI is when the doctor says the client has healed as much as they're going to heal. Settlements are negotiated AFTER MMI because that's when the full extent of damages is known. Settling too early = leaving money on the table. This is why we track treatment and make sure clients don't drop off.

Insurance Adjusters Are NOT Your Friend

Their job is to pay as little as possible. They're trained to get recorded statements, find reasons to deny claims, and pressure people into quick, lowball settlements. The #1 thing a client should do: never talk to the other driver's insurance without an attorney.

The 3 Insurance Policies Involved

1. Client's PIP: Covers first $10K in medical/lost wages regardless of fault. 2. At-fault driver's BI (Bodily Injury): This is where the real settlement comes from. Florida minimum is only $25K/$50K. 3. Client's UM (Uninsured Motorist): Covers the client if the at-fault driver has no insurance or not enough. Many people don't know they have this coverage.

Why Quick Settlements Are Bad

Insurance companies offer quick settlements because they know the case is worth MORE than what they're offering. Once a client signs a release, it's over — they can never come back for more money, even if their injuries worsen. This is why having an attorney matters. Attorneys know the real value.
